You cannot scroll down to get it if it is you only weapon although you can scroll up.

its an annoying bug coz when i run out of ammo i always forget i need to move mouse scroll the other way and i eventually get headshoten :\

Eh.. if you roll DOWN long enough.. it goes to normal pistol :D

Maybe its for sumthing it auto switches to starting pistol?
and the top is for other weps there should be a reason....
